Terms of Service

1. Acceptance of Terms

By accessing or using QuizOps at https://quiz.autoshiftops.com ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms constitute a legal agreement between you and AutoShiftOps (Sudhakar Sajja), Mississauga, Ontario, Canada ("we", "us", "QuizOps").

2. Description of Service

QuizOps is a platform that allows:

Publishers: To create knowledge quizzes from article content using AI, publish them, and share them with readers.
Readers: To take quizzes and track their comprehension of technical content.
Community contributors: To contribute quiz banks via our open-source GitHub repository.

3. Account Registration

3.1 Eligibility

You must be at least 13 years old to use QuizOps. By using the Service, you confirm you meet this requirement.

3.2 Google Authentication

Account creation requires a valid Google account. You are responsible for maintaining the security of your account.

3.3 Publisher Accounts

Publisher accounts require a unique username. By creating a publisher account, you agree to use the platform in accordance with these Terms.

4. Publisher Terms

4.1 Content Ownership

You retain all ownership rights to the articles and quiz content you create. By publishing a quiz on QuizOps, you grant us a non-exclusive, worldwide, royalty-free licence to display, distribute, and transmit that content solely for the purpose of operating the Service.

4.2 Content You Submit for AI Generation

When you submit an article URL or text for AI quiz generation:

You confirm you have the right to submit that content (it is your own content or content you are permitted to use).
The content is sent to OpenAI's API for processing. See our Privacy Policy for details.
You accept responsibility for ensuring the content complies with these Terms.

4.3 Acceptable Content

You may only submit content that is:

Educational, informational, technical, or professional in nature
Content you own or have permission to use
Accurate and not intentionally misleading

4.4 Prohibited Content

You may NOT submit or publish content that is:

Adult, explicit, or sexually suggestive
Violent, threatening, or promoting self-harm
Hateful, discriminatory, or harassing
Illegal, fraudulent, or promoting illegal activity
Spam, SEO junk, or low-quality generated content
Copyrighted content you do not have rights to use
Misinformation or deliberately false information

Violation of this section may result in immediate account suspension.

4.5 Content Moderation

We use automated AI-based content moderation to screen submitted content. We reserve the right to remove any content that violates these Terms without notice.

5. Free and Paid Tiers

5.1 Free Tier

Free accounts may publish up to 3 quizzes. No payment is required. Features are limited as described on our pricing page.

5.2 Pro Tier

Pro tier subscriptions are billed monthly or annually. Pricing is as listed at https://quiz.autoshiftops.com/pricing. Subscriptions auto-renew unless cancelled.

5.3 Enterprise Tier

Enterprise agreements are subject to separate contract terms agreed between the parties in writing.

5.4 Refunds

We offer a pro-rata refund for annual Pro subscriptions cancelled within 14 days of payment. Monthly subscriptions are non-refundable after the billing date.

6. Intellectual Property

6.1 Our IP

QuizOps, its logo, design, and software are owned by AutoShiftOps. Nothing in these Terms transfers any of our intellectual property to you.

6.2 Open Source

The quiz engine codebase is available on GitHub under the MIT licence. Community quiz banks contributed via GitHub are licensed under MIT.

6.3 AI-Generated Content

Quiz questions generated by AI from your article are owned by you as the publisher. We make no claim to AI-generated quiz content.

7. Prohibited Uses

You may not:

Use the Service to generate content for any prohibited purpose listed in Section 4.4
Attempt to reverse engineer, scrape, or extract data from the Service
Circumvent rate limits, tier limits, or content moderation systems
Use the Service to train competing AI models
Share your account credentials with others
Use the Service for any unlawful purpose

8. Disclaimers

8.1 No Warranty

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated questions will be accurate.

8.2 AI Accuracy

Quiz questions are generated by AI and may contain errors, inaccuracies, or omissions. Publishers are responsible for reviewing and editing AI-generated questions before publishing.

8.3 Third-Party Services

We are not responsible for the availability or performance of third-party services including Google, OpenAI, Supabase, or Vercel.

9. Limitation of Liability

To the maximum extent permitted by law, QuizOps and AutoShiftOps shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you shall not exceed the amount you paid us in the 12 months prior to the claim.

10. Termination

We may suspend or terminate your account at any time if you violate these Terms. You may delete your account at any time by contacting admin@autoshiftops.com. Upon termination, your published quizzes will be removed from public access.

11. Changes to Terms

We may update these Terms from time to time. We will notify you by updating the "Last Updated" date and, for material changes, by email. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ontario, Canada.
